Kenosha Teen to Face a Lesser Homicide Charge

The Kenosha County District Attorney’s office believes the shooting death last weekend of 23 year-old Sean Bialas was an accident and not the result of an intentional act.

Assistant District Attorney Tricia Riley said Wednesday that her office won’t be seeking a charge of intentional homicide against the victim's 15 year-old cousin. He reportedly had his hands on the gun when it went off. 

Even though they'll spare the teen the highest murder charge, prosecutors are seeking to have the boy tried in adult court. A waiver hearing will be held in April.

In addition to the negligent homicide charge, the youth faces charges of possession of a dangerous weapon by a person under 18 and obstructing. The teen reportedly told multiple versions of what had happened.

The boy will remain in juvenile detention until the scheduled waiver hearing on Apr. 24th.
