Whitaker Supreme Court Appeal May Not Have Unanimous Board Backing

There’s a strong sign that the Kenosha School Board’s decision to appeal an unfavorable ruling from a federal court in Chicago in the Ash Whitaker transgender bathroom case was not unanimous.

All of the board’s deliberations on the matter have been conducted in closed session, with board members unable to comment publicly. But at this week’s school board meeting, two board members reacted to a call from a retired school counselor to form a committee to work out transgender issues in lieu of appealing to the U-S Supreme Court.

In a sign of dissent, Rebecca Stevens said she fully supports the committee idea. "Let's iron it out through policy," she said, adding, "Let's celebrate the fact that the 7th District upheld and ruled to protect the rights (of transgender students)." 

But that ruling that Stevens wants to celebrate runs counter to the district’s official position.

It's also the ruling that KUSD and its insurance company are appealing to the nation's highest court.

The other board member who reacted to the counselor’s comments Tuesday night was Gary Kunich, who said he welcomed a chance to get a definitive ruling on whether the district can legally bar transgender students from using bathrooms of their gender identity.
