A Tremper High School senior who challenged the school district on its bathroom usage policy last fall has won another round in court. A federal appeals court Tuesday upheld a lower court ruling that had allowed Ash Whitaker to use the bathrooms at Tremper High School of his gender identity.
Ash will graduate on Saturday. But that won’t be the end of the court case. It now goes back to U-S District Judge Pamela Pepper in Milwaukee. If Pepper affirms her earlier ruling, then there are other issues to decide, according to one of Whitaker’s attorneys, Joseph Wardenski. Among them: Compensatory damages and school board policy.
Ron Stadler, an attorney for the Kenosha School Board, said he’s disappointed with the appeals court ruling. Stadler says the board will now consider its options, including asking the appeals court for another review or going to the U-S Supreme Court.

UW-Parkside Chancellor Debbie Ford has issued a statement of condolence in the wake of the traffic deaths of three Burlington area residents, one of which was a student at the school. 20 year-old Landen Brown, a passenger in a vehicle that left a road in Walworth County Sunday night, struck a tree and burst into flames. Ford said that Brown was known to many because of a key role he played in Parkside Range, the university's contemporary a cappella group that performed just recent at Parkside's commencement ceremony.
