(WGTD)---The U.S. Equal Employment Opportunity Commission has filed a federal lawsuit against Walmart for alleged incidents that occurred several years ago at its store in Mt. Pleasant.
According to a news release from the agency, Walmart violated federal law when it refused to accommodate an employee who required a job coach due to his intellectual disability and subjected him and a co-worker to a hostile work environment based on their disabilities. The employees were cart pushers.
The lawsuit contends that supervisors called the employees “stupid” and “slow.”
One employee said his supervisor called him a “retard” and shut the store’s door on him, sending him home early.
The lawsuit also alleges Walmart denied one of the employees the "reasonable" accommodation of a job coach, refusing to speak with job coaches assisting the employee at no cost to the company.
The suit alleges that the conduct violated the Americans with Disabilities Act.
The news release says a settlement could not be reached through a pre-litigation process.
Here's Walmart’s response to the lawsuit: “We don’t tolerate discrimination of any kind and provide reasonable accommodations to thousands of associates. We will defend the company against this litigation.”
