Charges Filed in Kenosha County Cold Case

(WGTD)---Charges have been filed in a nearly 22-year-old Kenosha County murder.

John Viskocil and Roxanna Collins, both 70, have been charged with Party to the Crime of 1st Degree Intentional Homicide in the death of 47-year-old David Vanderzee. The murder is one of a dozen cold cases that are outlined on Kenosha County's website. 

Vanderzee was shot in the head five times in his Powers Lake home the evening of Sept. 23rd, 2003.

Vanderzee's body was discovered by Collins, his then-wife of just two months. 

According to the criminal complaint, authorities believe Collins was having an extra-marital affair with Viskocil, who lived nearby, and that Viskocil shot Vanderzee in concert with Collins.  Viskocil and the victim were described in the complaint as good friends. 

While there's no 'smoking gun', an eight-page criminal complaint builds a case of circumstantial evidence against the defendants, culminating in new incriminating statements from Viskocil's then-girlfriend. Janie Dunham disclosed to investigators this year that she and Viskocil had been having relationship problems, and that she believed that the defendants were having an affair. Collins moved into Viskocil's home just as Viskocil and Dunham were breaking up. 

Dunham counters Viskocil's alibi. Viskocil claimed that he'd been fishing from his boat by himself the evening in question, an activity that Dunham said was odd and out of character. Dunham also noted that when Viskocil returned from his purported fishing trip he immediately put the clothes he'd been wearing into the washer. Viskocil later claimed to investigators that he did so because he had fallen into the lake and needed to change. Dunham doesn't recall Viskocil coming home wet, and certainly doesn't remember making a fuss over a wet mess, as Viskocil initially claimed shortly after the murder. 

An examination of logs of telephone calls made and received by the defendants and the victim leads investigators to believe that Vanderzee was shot within a 90-minute window. They also suspect that Vanderzee, a Navy veteran, knew his assailant and wasn't fearful because there was no sign of either forced entry or a struggle. 

According to online records, Viskocil was arrested Wednesday. A warrant was issued for Collins, who currently lives in McHenry, Illinois.
