Judge Drops Sexual Assault Charges After Children Recant

A 52-year-old man who has been sitting in the Kenosha County Jail---awaiting trial on sexual assault charges---since December 2013---was set free on Monday AFTER the alleged juvenile victims recanted. The Kenosha News is reporting that Jesus Palacio---described as homeless in court records---was taken in by some relatives.

The prosecutor in the case said the children and their mother---who now live out-of-state---recanted their stories during a phone call related to Palacio’s upcoming trial. The newspaper reports that Palacio---who has a long history of mental illness as well as limited English skills---was charged in 2013 after a then 11-year-old girl claimed he had touched her genitals. She also said Palacio touched her two sisters as well. They were 13 and 8 at the time. Palacio was staying with the family at the time.

It’s unclear what legal ramifications face the kids who made up the story.
